Villa Rental Agreement
KASKA VILLA RENTAL AGREEMENT
In this agreement, the person renting the villa is referred to as the Tenant, and the party letting the villa is referred to as Kaska Villa.
This agreement is entered into between the Tenant and Kaska Villa for the rental of any apartment or villa listed on www.kaskavilla.com for a period with an agreed start and end date.
After the Tenant submits a request for the relevant villa or apartment through www.kaskavilla.com, the necessary checks are made. If there is no issue, the provisional hold process begins and an option email is sent. By paying the advance payment and completing the reservation, the Tenant and accompanying guests accept the conditions below in advance. A breach of any condition gives Kaska Villa the right to cancel the reservation unilaterally, require the Tenant to leave the villa and retain the payment received.
The Tenant may not transfer rights or obligations under this agreement to third parties without Kaska Villa's approval. Kaska Villa may transfer its rights and obligations under this agreement to third parties.
To confirm a reservation, an advance payment of 30% of the total rental price is required; this may vary by villa and may be 20%. Reservation information is emailed to the Tenant after payment. Making the advance payment constitutes acceptance of this agreement's terms and conditions. The Tenant must pay the remaining balance when checking into the villa.
No refund is given if the Tenant wishes to leave or leaves after check-in for any reason.
As Kaska Villa acts as an intermediary between the Tenant and the villa or apartment owner, it issues an invoice for its commission relating to the rental.
The advance payment sent for a reservation is non-refundable.
For cancellations made 60 days or more before the reservation date, 50% of the total price is collected from the Tenant. For cancellations made between 60 and 31 days beforehand, 70% is collected. For cancellations made 30 days or less beforehand, or if the Tenant does not arrive without notifying cancellation, the full total price is collected.
If the Tenant wishes to change the reservation dates, a change may be made with the villa or apartment owner's agreement for an additional charge of TRY 1,000. The selected villa or apartment cannot be changed.
If the reservation is cancelled by the villa or apartment owner or by Kaska Villa, Kaska Villa must refund the Tenant's advance payment in full.
Kaska Villa is a website acting as an intermediary between villa or apartment owners and Tenants. It accepts no responsibility for problems relating to the rented villa or apartment arising from accidents, illness, fire, theft, death, drowning, excursions, shopping, food, entertainment, transport, travel or power outages. All responsibility belongs to the property owner. Kaska Villa is responsible for forwarding complaints from the Tenant to the relevant parties as promptly as possible.
No additional fee is charged for pool and garden cleaning, electricity, water or internet expenses.
Staff responsible for pool maintenance must be allowed to enter and remain in the necessary areas to carry out periodic maintenance.
Arrival cleaning is included in the price for daily, weekly and monthly rentals. Weekly cleaning is included for rentals longer than one week. Additional cleaning or a change of bed linen is charged separately. Depending on the villa, an extra cleaning fee may apply to short stays; where applicable, it is included in the reservation amount and varies by property.
At the specific request of some villa or apartment owners, stays shorter than one week may incur a cleaning fee, or rentals of less than one week may not be permitted.
Pool temperatures at properties with heated pools range from 20°C to 29°C. Kaska Villa is not responsible if the pool fails to heat because of an electricity outage.
Kaska Villa is not responsible for illnesses or allergies caused by water from the rented property's swimming pool or shower.
Kaska Villa is not responsible for animals, pests, insects or smells from fertiliser in or around the rented apartment or villa. Such conditions may occur at properties in natural surroundings.
A damage deposit of TRY 5,000 to TRY 30,000 is collected on arrival and returned on departure if there is no damage and the property is left clean. If damage is identified at check-out, its cost is deducted from the deposit and the remaining amount is returned to the Tenant. If the deposit is insufficient, the Tenant must pay the balance in cash at that time. Guests are responsible for covering damage they cause to the property.
No more guests may stay than the capacity stated on the villa or apartment's details page. If the number is exceeded, the owner has the right to require the additional guests to leave or to request an extra payment. Every child over 2 years old is included in the occupancy count.
Pets and smoking are not permitted inside the rented property.
Check-in is no earlier than 16:00, and check-out is no later than 10:00.
Tenants are advised to arrange personal insurance, including life, health, theft and travel cover as appropriate.
If Tenants engage in conduct that disturbs the surroundings or constitutes an offence during the rental period, Kaska Villa may cancel their reservation without a refund.
Villas in the category described as having pools screened from outside view are not guaranteed to provide 100% visual privacy. Kaska Villa accepts no responsibility for circumstances in which visibility from outside occurs.
Kaska Villa does not share the Tenant's personal information, such as name, surname, address, telephone number or email address, with third parties. This information is used to obtain statistical data and send campaign information. Kaska Villa accepts no responsibility if third parties obtain the data as a result of a cyberattack.
The Tenant is responsible for transport to the rented apartment or villa.
Kaska Villa is not responsible for dissatisfaction or problems relating to the roads, geographical location, decoration or materials used in the rented villa or apartment.
Geographical location information provided by Kaska Villa is approximate.
Kaska Villa is not responsible for accidents, problems or deaths arising from materials used in the property's construction or from its facilities, nor for health problems such as insect bites, poisoning or allergies.
Kaska Villa is not responsible for problems involving insects or pests at villas and apartments offered in natural surroundings.
Differences in colour, apparent size or the replacement of decorative items compared with photographs on the Kaska Villa website do not constitute grounds for cancellation.
A refund is made for reservation cancellations arising from events beyond control affecting society or from individual force majeure circumstances, such as a threat of war, terrorist activities, natural disasters, health risks, an epidemic or the death of a first-degree relative.
The rental conditions remain fully applicable if an employee of a public or private organisation has their leave cancelled.
In the event of a fault arising from the rented property that cannot be repaired, a refund is calculated for the number of days during which the property is not occupied. No refund is given for days already spent there.
The Tenant must check into the rented apartment or villa on the agreed date and pay the remaining balance. If the Tenant wishes to arrive on another date within the reservation period, the full remaining reservation amount must still be paid on the original start date. If payment is not made, Kaska Villa reserves the right to take legal action.
Under Article 15/g, titled “Exceptions to the Right of Withdrawal”, of the Regulation on Distance Contracts published by the Turkish Ministry of Industry and Trade in Official Gazette No. 29188 dated 27.11.2014, the Tenant may not exercise a right of withdrawal. If the Ministry of Tourism revokes the villa or apartment's permit under Law No. 7464 on the Rental of Residential Properties for Tourism Purposes, the reservation is cancelled to prevent inconvenience to the Tenant and an equivalent alternative villa is offered. The Tenant pays any price difference, or the reservation is cancelled and a refund is made.
A Tenant booking any villa or apartment is deemed to have read and accepted all the terms and conditions above. A breach gives Kaska Villa the right to cancel the reservation unilaterally, refuse a refund and demand the full price.
Severability: If any non-essential provision of this agreement, or part of one, is legally invalid in whole or in part, and the remaining provisions can be performed without it, that invalidity applies only to the provision or part concerned. It does not affect the validity or enforceability of the other provisions.
By accepting this agreement, the Tenant is also deemed to accept the Privacy and Security Policy and the Cookie Policy.
The Kaş Enforcement Offices and Courts have jurisdiction over disputes arising in connection with this agreement.
